Russia vs. Georgia - conflict 2008: Legal analysis of the use of force of Russian Federation

Abstract

Since there are so many conflicts happening in the world nowadays and International Humanitarian Law (IHL) develops every day, it is very essential that all the conflicts are studied carefully and the wrongful acts are punished, or at least revealed. Russian-Georgian conflict 2008 is a relevantly new conflict which will be a very essential precedent for deciding on future cases. It might be impossible to prevent use of force at all, however it is possible to make States think how to justify their actions in case if it decides to use force no matter what. So, the main aspects on which this paper will concentrate are the justifications of the conflict. Present paper will give the qualification to the use of force and provide with the legal analysis of the Russian Federation’s use of force against and on the territory of Georgia. The present paper also seeks to draw general conclusions and provide with recommendations about the exceptions of the use of force with regard to modern armed conflicts.
